We are often engaged by lenders to perform a business review of viability assessment. The lender having determined that a borrower is experiencing financial difficulty must evaluate its security position and must determine the proper course of action to minimize its exposure.
A work-out plan may evolve depending on early identification of the problem and on the early acceptance by management of the need for outside help.
In certain instances, corporate recovery is not feasible solution and the company must liquidate. Miller Hersh Inc. will act as receiver or agent for the lenders to realize on the security by liquidating a business or disposing of certain assets to maximize realization and minimize a loss to the lender. We will also act as trustee in bankruptcy to take possession of assets and dispose of them for the benefit of creditors as a whole.
